On March 26, 2014, Governor Pence signed into law House Enrolled Act 1266 (“HEA 1266”), Section 23 of which amends IC 6-1.1-18.5-8 regarding the township emergency fire loan. Please note that this memorandum is intended to be an informative bulletin; it is not a substitute for reading the law.
In 2013, IC 6-1.1-18.5-8 was amended so that a township’s repayment of its emergency fire loan under IC 36-6-6-14 fell within the township’s maximum levy. HEA 1266 amends IC 6-1.1-18.5-8 so that this repayment will fall outside the township’s maximum levy.
Because the amendment takes effect July 1, 2014, the placement of the loans outside townships’ maximum levies will first occur for the 2015 budget cycle.
