DLGF Publishes Guidance Regarding Necessity of a Level II or Level III Certification Before Taking Office

On March 20, 2014, Governor Pence signed into law House Enrolled Act 1318 (“HEA 1318”).  Sections 12 and 13 of HEA 1318 introduce changes affecting candidates for the offices of county assessor and township assessor. Please note that this memorandum is intended to be an informative bulletin, not a substitute for reading the law.

Section 12 of HEA 1318, effective January 1, 2015, amends IC 3-8-1-23 such that a candidate for the office of county assessor who runs in an election after June 30, 2008 must have attained the certification of a Level II assessor-appraiser before taking office. A candidate for county assessor who did not hold the office of county assessor on January 1, 2012 and runs in an election after January 1, 2012 must have attained the certification of a Level III assessor-appraiser before taking office. A candidate for the office of county assessor who held the office of county assessor on January 1, 2012; and runs in an election after January 1, 2016 must have attained the certification of a Level III assessor-appraiserbefore taking office.

Section 13 of HEA 1318, effective January 1, 2015, amends IC 3-8-1-23.6 such that a candidate for the office of township assessor who runs in an election after June 30, 2008 must have attained the certification of a Level II assessor-appraiser before taking office. A candidate for the office of township assessor who did not hold the office of township assessor on January 1, 2012 and runs in an election after January 1, 2012 must have attained the certification of a Level III assessor-appraiser before taking office.  A candidate for the office of township assessor who held the office of township assessor on January 1, 2012 and runs in an election after January 1, 2016, must have attained the certification of a Level Three assessor-appraiser before taking office.
