DLGF Publishes Guidance on Anti-Nepotism Rules for Local Governmental Units

On March 19, 2012, Governor Mitch Daniels signed into law House Enrolled Act 1005 (“HEA 1005”). HEA 1005 introduces new statutes implementing anti-nepotism rules and makes approval of the budgets of certain entities contingent on local government adoption of anti-nepotism policies.
This memorandum provides guidance on these rules which take effect July 1, 2012, namely regarding:
· employment of relatives of elected officials in the same unit (IC 36-1-20.2),
· contracting with relatives of elected officials (IC 36-1-21), and
· the obligation of counties, municipalities, and townships (“units”) to adopt anti-nepotism policies before their budgets can be approved by the Department of Local Government Finance (“Department”) (IC 5-11-13-1.1).
